Forecaster AI — Terms of Use

DRAFT v1.0.1 (2026-10-27) — NOT LEGAL ADVICE. Have a licensed attorney in Michigan review and finalize before you charge anyone. Everything in [BRACKETS] must be filled in. Sections marked ⚖️ are decisions your attorney should make.

Effective date: [EFFECTIVE DATE] Terms version: [TERMS_VERSION — must match the TERMS_VERSION setting on the server]

These Terms of Use ("Terms") are an agreement between you and Griffin Keystone LLC, a Michigan limited liability company ("we," "us"), located at [BUSINESS ADDRESS]. They cover the Forecaster AI website at https://forecaster-ai-storm-chaser.netlify.app, the Forecaster AI Android app, and everything in them (together, the "Service"). By subscribing, unlocking, or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 18 years old to subscribe or use the Service. By using it you confirm that you are 18 or older and able to enter into a contract.

2. What the Service is — and what it is not

2.1 Information only. Forecaster AI shows weather forecasts, radar, alerts, space-weather and earth-science information gathered from public and licensed sources, plus its own statistical forecast ("Rogue"). It is for general information and entertainment.

2.2 NOT an official source. NOT for life-safety decisions. We are not the National Weather Service (NWS), NOAA, or any government agency, and we are not endorsed by them. Forecasts can be wrong. Warnings and alerts shown or sent by the Service can be late, incomplete, or missing, including because of network problems, your phone's battery or power-saving settings, third-party outages, or errors in our software. Never rely on the Service to protect life or property. For emergencies call 911. For official warnings use the NWS (weather.gov), NOAA Weather Radio, Wireless Emergency Alerts on your phone, and instructions from local officials.

2.3 Not professional advice. Nothing in the Service is aviation, marine, agricultural, medical, legal, insurance, or financial advice. Don't use it to plan flights, boating, or any activity where a wrong forecast could cause injury or loss.

2.4 Statistical and AI features. "Rogue" is a statistical correction method (it compares past model forecasts with weather-station readings and adjusts for repeated errors). It is not a guarantee and may be less accurate than official forecasts at your location. The optional chat assistant uses an AI language model that runs on your device, or — only if you add your own key — Groq's online service. AI answers can be wrong, out of date, or offensive. Check important information against official sources.

2.5 Optional profanity. Some voice styles can use crude language. This is off or mild by default and is shown only if you turn it on.

3. Your access

3.1 Unlocking. After you subscribe through our Square checkout, you unlock the Service with the email address you used at checkout and the last 4 digits of the card you paid with. We use this only to confirm your subscription.

3.2 Devices and sharing. One subscription may be used on up to [MAX_DEVICES, default 3] devices at a time. Unlocking a new device may sign out the oldest one. Don't share your access with people outside your household, resell it, or help anyone get around the paywall.

3.3 Staff/complimentary codes. We may give free access codes at our discretion and may turn them off at any time.

4. Subscriptions, automatic renewal, and cancellation

4.1 Plans and price. Monthly: [PRICE MONTHLY] per month. Yearly: [PRICE YEARLY] per year. Prices are in US dollars and do not include taxes unless stated. Payments are processed by Square, Inc. under Square's terms; we never receive your full card number.

4.2 AUTOMATIC RENEWAL. YOUR SUBSCRIPTION RENEWS AUTOMATICALLY at the end of each monthly or yearly period, and your payment method is charged the then-current price for the same period, until you cancel. You agreed to this by checking the automatic-renewal box before checkout.

4.3 How to cancel. You can cancel online at any time in the app: Settings → Account → Cancel subscription, or by emailing [SUPPORT EMAIL]. Cancellation takes effect at the end of the period you have already paid for; you keep access until then and won't be charged again.

4.4 Refunds. [REFUND POLICY — ⚖️ choose one with your attorney]. Some states and countries give you additional rights, and nothing here limits them.

4.5 Failed payments. If a payment fails, Square may retry it. If your subscription isn't paid within [GRACE_DAYS, default 3] days after the paid period ends, access to the Service stops automatically (including background alerts in the Android app) until payment is made.

4.6 Price changes. We will tell you about any price change at least [30] days before it applies to you, and you can cancel before it takes effect.

4.7 Yearly renewal reminder. ⚖️ [For yearly plans we will send a reminder to your email between [15] and [45] days before renewal, stating the date and amount and how to cancel.]

5. License and rules of use

We give you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes while your subscription is active. You may not: copy, resell, or redistribute the Service or its data; reverse engineer it except where the law allows; scrape it or overload it with automated requests; use it to build a competing product; remove notices or attributions; break or bypass the access controls; or use it for anything illegal.

6. Third-party data and services

The Service displays data and maps from third parties, including the U.S. National Weather Service, NOAA (SPC, NHC, WPC, CPC, SWPC), NASA, USGS, Iowa State University's Iowa Environmental Mesonet, [Open-Meteo — paid commercial license, required before launch], map providers, and others listed in the in-app Disclosures. We don't control them, they may change or stop, and their data may be wrong or delayed. Use of the U.S. government's data does not mean any agency endorses us. If you add your own Groq API key, your use of Groq is governed by Groq's terms.

7. The Android app

The Android app is distributed directly by us (outside the Google Play Store). It asks for location, notification, and startup permissions to deliver alerts. Background checks run on Android's schedule (about every 15 minutes at best) and can be delayed or stopped by Android's power-saving features. You can turn them off in the app at any time.

8. Privacy

Our Privacy Policy (/legal/privacy.html) explains what we collect and why.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT FORECASTS, ALERTS, OR ANY OTHER CONTENT WILL BE ACCURATE, TIMELY, OR AVAILABLE.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS RESULTING FROM RELIANCE ON ANY FORECAST, ALERT, OR AI OUTPUT. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow some of these limits; in those places they apply only as far as the law permits. ⚖️

11. Indemnity

You agree to defend and hold us harmless from claims arising from your misuse of the Service or your violation of these Terms.

12. Suspension and termination

We may suspend or end your access if you break these Terms or if required by law. You may stop using the Service and cancel at any time (Section 4.3). Sections 2, 9–13 survive termination.

13. Disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. ⚖️ [OPTION A: Courts in [COUNTY], Michigan have exclusive jurisdiction, except either party may use small-claims court.] [OPTION B: Binding individual arbitration with class-action waiver — only with attorney drafting.]

14. Changes to these Terms

We may update these Terms. For material changes we will notify you in the app or by email at least [30] days before they take effect, and ask you to agree again. If you don't agree, you can cancel.
